TERMS AND CONDITIONS

Before booking at Carve Studio please read through the terms and conditions. By booking a class and/or entering our studio you agree to be bound by these terms and conditions set out below.

Carve Studio reserves the right to update, amend or reissue these terms and conditions at any time. Any changes will be notified by email, on our website or otherwise at the Studio. By continuing to utilise the services provided by Carve Studio you are agreeing to such changes.

References to “we”, “us” and/or “our” in these Terms and Conditions is a reference to Carve Studio Limited.

GENERAL TERMS AND CONDITIONS

1. Introductory offer

Our Introductory offer of 4 classes (valid for 14 days) is only available to new clients that have not attended a class at Carve Studio before. You can only purchase the introductory offer one time. The introductory offer is non-refundable and will activate from the date of your first class booking. Any individual who attempts to buy or is found to have bought the introductory offer more than once may be suspended and charged any additional class costs they may have incurred.

2. Cancellation policy

a) Group Classes

If you have booked to attend a class and would like to cancel, you must cancel through the online booking system only - accessible via carvestudio.co.nz, the Carve Studio app or the Momence app.

In order to cancel your attendance without penalty, you must process a cancellation using the online booking system at least 8 hours prior to the scheduled commencement time for the class as detailed in our Class Schedule (“Early Cancellation Window”). We will not accept cancellations by phone, text message, email, social media or any other method other than by using the online booking system.

If you cancel within 8 hours of the scheduled commencement time for the class you will forfeit the class from your pass. No exceptions, refunds or class credits.

If an individual repeatedly late cancels or ‘no shows’ to classes, Carve Studio has the right to suspend the individual’s account from booking classes for a period of one week. Additional fees may also be charged.

b) Private Sessions

Private sessions can be purchased online through our website or app. Once purchased, contact us via email or phone to arrange a time for your private session.

Notice of cancellation for private, duet or any other privately arranged session/class must be in writing and provided to Carve Studio with at least 24 hours notice. Credits will not be provided if notice is outside of this period and the session will be forfeited at the full price paid for the session.

Cancellations must be made via message on the Carve app, call/text (please refer to the Carve Studio website for the phone number) or confirmed in writing via email to hello@carvestudio.co.nz only.

3. Booking

To sign up to participate in our classes, you must create an account with us. Your account will be governed by these Terms and Conditions and our Privacy Policy.

There are a set number of spaces in each class. To attend a class, you must reserve a space. Bookings can be made online, via the Carve Studio website or Carve Studio app or Momence app.

You will not be able to book a class without purchasing a class pass first.

4. Waitlists

If a class you wish to attend is full, you can sign up for the waitlist. Should a space become available 8 hours or more before the class you will be automatically added to the class from the waitlist. If a space becomes available within 8 hours of the class starting, you will receive either an email or text from us that you have been added from the waitlist up to an hour prior to the class start time. Ensure you have your notifications enabled.

Placing yourself on a waitlist indicates your intention to attend that class and you are required to cancel yourself off the waitlist or class if you can no longer attend. Late cancellation and no show charges do apply to missing a class you were placed into from the waitlist.

5. Late entry

Out of consideration for our instructors and your fellow members, and for your own safety you may be refused entry to the class if you arrive late/once the class has already started. New clients must arrive 10 minutes early, no late entry at all will be permitted if it is your first class at Carve Studio. Please also be aware that if you are late for a class, your spot may be given to a waitlisted client.

6. Minimum class numbers

A minimum of three people is required for a class to proceed. You will be contacted via text message at least 2 hours prior to the start of class should it need to be cancelled and your session returned to your account.

7. Pricing

The pricing for our services is outlined on both our website, the Carve Studio app and the Momence app. From time to time our prices may change. Any pricing changes will be notified to existing clients in writing via email with at least two weeks’ notice.

8. Class Packs

Classes must be paid in advance. This can be done by purchasing a casual class or class pack on our website or Carve Studio app. Each class pack has its own terms and conditions such as expiry periods, these are outlined on our website under ‘pricing’ under the relevant pack.

Class packs are non transferable and may not be sold, traded, gifted, shared, provided or otherwise transferred to any person other than the purchaser.

The expiry date on class packs is final. If class credits remain on the pack at the date of expiry then those classes will expire and no refund will be given for any unused classes.

To the extent permitted by law, we do not offer any refunds, transfers, suspensions or extensions on a casual class, class pack or membership for change of mind, user error, injury, illness, change of address, unsuitability or any other reason. All purchases are final.

9. Medical warning

Participating in any form of exercise at Carve Studio is done entirely at your own risk. Members are advised to seek medical advice prior to commencing any exercise programme if they are in any doubt about their ability to engage in exercise.

You must inform us and any instructors prior to commencement if there are any risks to your health by participating in our classes, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, (a “Medical Condition”). Where you have a Medical Condition, we strongly recommend that you seek approval from a medical practitioner to participate in any of our classes. Participating in any form of exercise at our studio with a Medical Condition is done entirely at your own risk.

By undertaking any exercise programme (including the use of any equipment purchased from us), you acknowledge that you do so at your own risk and that Carve Studio and/or our instructors will not be liable for any personal injury, loss or liability of whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise programme or following advice contained on our website or given by our instructors.

10. Pregnancy and Postnatal

Pre and postnatal specific classes are sometimes offered at Carve Studio. These specialty classes are safe for pregnant clients to attend throughout their entire pregnancy up to full term, if they feel comfortable to do so. Pregnant clients are also welcome to attend our ‘All Levels’ classes.

We ask that prior to booking with us any pre or postnatal clients are cleared by a doctor, lead maternity carer or a women’s health physio to attend Reformer Pilates sessions. A 1:1 private session is also highly recommended to ensure you are comfortable with the modifications required while pregnant or postpartum.

11. Socks

For safety and hygiene reasons, grip socks are compulsory at our studio. Grip socks are available for purchase at the studio.

12. Children in studio

With the exception of our ‘BYO Baby Series’ (where non-mobile babies are able to attend with their parent or guardian), we do not allow children in the studio. Children are not to be left in the studio waiting area while you attend classes.

13. Safety of belongings

We are not responsible in any way for the safekeeping of your personal belongings. We recommend that you bring only any personal belongings into our studio which are absolutely necessary for you to possess for the duration of your visit.

14. Schedule and Studio Hours

We reserve our right to change our opening hours at any time. You will be notified of any permanent changes to our opening hours. Carve Studio may reduce the class schedule or close for Christmas, Easter, other public holidays or any other day at our own discretion.

We are not liable in any way to provide you with a refund, credit, transfer, or to offer compensation of any kind, for Classes that are not held in accordance with the Class Schedule, but may choose to do so at our sole discretion.

15. Payment

It is your responsibility to ensure there are sufficient funds available in your nominated bank account or credit card to cover the cost of purchasing any membership, class packs or other products from us.

If a payment is declined for any reason, we reserve the right to process payment at any time where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed. If an auto-debit is declined due to insufficient funds, our payment provider may charge for failed transactions. If incurred, this fee will be passed on to you approximately 7 days after the failed payment.

We are in no way responsible for additional fees that you may incur from your bank in relation to processing the payment of fees.

16. Gift Vouchers

Gift vouchers can be used for classes and products at Carve Studio. They are not redeemable for cash and are non transferable.

Gift vouchers have a strict expiry date. Unredeemed balances on gift vouchers are not refundable.

Carve Studio does not offer refunds, transfers, suspensions or extensions on gift vouchers for change of mind, injury, illness, change of address or any other reason. All purchases are final.

17. Promotions

From time to time Carve Studio may offer promotions. Please check with the studio for the terms and conditions associated with the relevant promotion.

18. Video, Photography, Social Media and Copyright

From time to time video footage and photographs will be taken at Carve Studio and during our classes.

By attending a class and/or entering our studio you grant Carve Studio permission to photograph or video you. You agree that any video or imagery captured may be used in Carve Studio advertising or marketing campaigns, on the Carve Studio website and social media channels, and for promotional and informational material including, but not limited to, flyers, brochures, emails, advertisements, newspaper articles and TV interviews/promotions. You understand that you will not be identified by name unless you give your permission and you hereby waive and release any rights to compensation for, or ownership of, such images.

19. Your Personal Information

Your personal information collected by us in accordance with these Terms and Conditions will at all times be dealt with in accordance with our Privacy Policy, a copy of which can be viewed in full on our website.

20. Limitation of Liability

Except for any liability that cannot be excluded by law, Carve Studio (including its officers, employees and agents) excludes all liability for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss or corruption of information or data); whether direct, indirect, special or consequential, arising in any way out of your attendance at our classes. This includes but is not limited to any theft, unauthorised access or third party interference.

21. Account termination

Carve Studio may terminate a client’s account and access to our studio without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members. Any class credits on the terminated account will not be refunded or transferred.

CARVE STUDIO MEMBERSHIP TERMS AND CONDITIONS

The Parties

This contract is between the member ("customer") and Carve Studio Limited (“Carve Studio“).


Minimum term

By purchasing a membership the customer agrees to the MINIMUM 12-WEEK TERM. This minimum term does not include any pause periods. A Minimum Obligation Agreement means an agreement that has a minimum term commitment to maintain payments, post this minimum term the agreement will continue indefinitely until terminated by the customer or Carve Studio.

Credit rollover

Memberships will give the customer a number of class credits to be used within 1 week (2 credits for 2 per week members, 3 credits for 3 per week members and 4 credits for 4 per week members). As a courtesy, any unused credits will automatically roll over to the following week, and if these remain unused they will expire.

Weekly payments

Payments will be charged weekly at the agreed membership rate ($49 per week for 2 per week members, $65 per week for 3 per week members and $79 per week for 4 per week members) to the debit or credit card on file for the customer. Weekly payment will be taken within 24 hours of the chosen date. If the date falls on a weekend day or a public holiday the time period may be within 24 hours from the start of the next business day.

Failed payments

If a recurring payment fails on the first attempt, our provider Momence will attempt to take the payment three more times over the coming days making it 4 attempts in total to take payment. Carve Studio will contact the customer after the first failed payment to request the outstanding payment is resolved immediately. After the first failed payment, the customer will not be allowed to use the membership to book classes until a successful payment has been made. Any fees our provider passes on to us related to failed payments will be charged on to the customer. If a balance is outstanding for more than 4 weeks Carve Studio may notify any credit reporting or referencing agency of the default, and may pass the customer’s debt for collection to a third party agency.


Changes in membership fees

Outside of any minimum term obligation agreed to by the customer, Carve Studio may adjust membership fees at any time giving 4 weeks’ notice.


Membership pauses

The customer has the option to pause their membership for a maximum of 6 weeks per year of membership (starting from day 1 of the membership). Pauses must be for a minimum of 1 week at a time. Memberships must be currently active for our system to be able to action the pause. Memberships will not be considered active without full payment up until the date of pause request. A pause must be requested in writing via email to hello@carvestudio.co.nz a minimum of 1 week before the start of the pause to ensure payments can be paused in time. If less than 1 week notice is given the pause request may be denied. The email must state the requested start date for the pause and the period the customer wishes to pause for. Customers will not have access to any bookings or facilities that form part of the Agreement while the pause is in place. Any further requests to pause additional to the 6 weeks allocated will only be considered with supporting documentation provided by a registered professional.


Termination/Changes

If a customer wishes to terminate their agreement or change their membership type, they must give at least two weeks’ notice. Customers cannot cancel their membership or change their membership to one of lesser value within the fixed term or minimum obligation period. In the event of requesting an early cancellation in extreme or medical circumstances documentation from a registered professional may be required.


Additional classes during a membership cycle

If a customer wishes to book into and attend classes additional to those in the payment cycle they will be able to purchase additional casual class credits at a reduced rate of $25 per class for 2 p/w members, $23 per class for 3 p/w members or $20 for 4 p/w members.

This pricing will automatically apply at check out when the customer is logged in to the account associated with the membership.

The additional credit will be valid as per the terms of a single casual credit (1 month from date of purchase).

Customers may not purchase additional classes at this reduced rate for any individual other than themselves.

Refunds and extensions

All memberships are non-refundable and non-transferable between customers. No refunds will be provided. No extension will be permitted to the specific valid time frame of class credits.

Bookings

Class bookings are essential and must be made through the Carve Studio app, Carve Studio website, or Momence app. Class bookings may be made up to two weeks in advance.

Waitlists

If a class is fully booked, customers are able to be added to a waitlist and if any cancellations may occur, they will be notified up to an hour before the class starts. If the customer adds themselves to the waitlist, they are committing to attend that class should a spot open up. Customers must remove themselves from the waitlist if they no longer wish to attend.

Class cancellation or rescheduling

Cancellations or rescheduling can only be made via the Carve Studio app, Carve Studio website or Momence app within the ‘early cancellation’ window (8 hours prior to class start time). Any cancellations made within 8 hours of the class start time will be considered a ‘late cancellation’ and the credit used to make this booking will be forfeited. Text message, social media messages, voicemails or phone calls will not be accepted as cancellation as these channels are not constantly monitored. Customers who repeatedly late cancel or no-show may be charged additional fees and/or have their membership suspended.

Minimum numbers

A class must have a minimum of 3 participants to run. Carve Studio reserves the right to cancel a class if need be. Customers will be contacted via text message at least 2 hours before the commencement of the class. Customers will not be charged and the session will be credited back to their account.

Holiday closures

If Carve Studio choses to close over holiday periods such as Christmas and New Year, the customer’s membership will be paused for the duration of the closure. This pause will not count towards the maximum 6 week pause per year allowance. Memberships will not be paused for individual public holiday days such as Anzac Day, Waitangi Day, Matariki etc. where Carve Studio has chosen to close.

Forced closure

If Carve Studio is forced to close due to any government restrictions, customers will be contacted via email and given the option to pause their membership in addition to the 6 week pause allocation. The pause period will be for the period of which Carve Studio is forced to close according to government regulations. If customers wish to extend their pause beyond the mandatory closed period, it will be considered part of the 6 week pause allocation (and the 1 week minimum term will apply).

Class restrictions

Owners and/or Instructors reserve the right to restrict or prohibit clients from particular class types for safety reasons.
